Act provides that any claimant, within six months after the determination of the matter, can seek to have
the court restore a forfeited item to him. However, such a claimant must prove that he is the lawful owner of
the property and that he did not know that the property would be unlawfully used or did not consent to the
offender so having possession.
The Act also provides that where a person is convicted of an offence and punishable on indictment with
imprisonment for a term of two years or more, forfeiture can be applied for in certain situations.This Act,
therefore, captures indictable offences for which there is no forfeiture provision in a particular enactment,
