TRUST CORPORATIONS
All jurisdictions (save Jamaica)
A trust corporation includes the Public Trustee, a corporation appointed
by the Court in any particular case to be a trustee or a person authorised to
act as custodian/ trustee under the rules of the public trustee legislation of
the relevant Caribbean territories.1
Jamaica and The Bahamas2
A trust corporation is any corporation authorised to act as an executor of
the will of any deceased person or as administrator of the estate of any
deceased person or as a trustee of any settlement whether constituted by
being any instrument or otherwise.
GRANT TO TRUST CORPORATIONS3
All jurisdictions (save Jamaica)
A grant of representation may be made to a trust corporation acting alone
or jointly with another person.
In this regard a trust corporation may be:
(a) named as executor of a will, in which event a grant of probate
is issued to the trust corporation either solely or jointly with
any other person(s) named as executor(s);
(b) nominated to take a grant of letters of administration (with or
without will annexed) on behalf of the person(s) entitled
thereto;
(c) authorised by a duly registered power of attorney to act as
attorney of the persons entitled thereto.
