Labour Law - Industrial Disputes — Settlement

REFERENCE:

By letter dated 3 rd November 1975, the Honourable Minister of Labour and Employment in accordance with section 9 of the Labour Relations and Industrial Disputes Act, 1975, referred to the tribunal for settlement a dispute between the Jamaica Omnibus Services Limited and certain of its employees represented jointly by the Bustamante Industrial trade Union and the National Workers Union.

The Terms of Reference to the Tribunal were as follows –

“To determine and settle the dispute between the Jamaica Omnibus Services Limited o the one hand and certain employees of the said Company represented jointly by the Bustamante Industrial Trade Union and the National Workers Union of Jamaica on the other hand arising from an incident between Driver Patrick Parkinson and Inspector Edwin Hylton on October 11, 1975.”

The parties submitted written briefs and at the sitting held on the 17 th May, 1976, they advised the Tribunal that further local level discussions had taken place and the matter had been resolved.

Subsequently, the parties advised by letter dated 1 st September, 1976 and 22 nd October, 1976 (APPENDIX A and B) that the matter had been amicably settled.

In the circumstances, it was not necessary for the Tribunal to adjudicate on this matter. We therefore make no Award.

With reference to our recent telephone conversation with the specific request of Dr. John Martin, (Chairman), we are to advise you that the matter has been amicably resolved between the parties as Driver Patrick Parkingson was paid for the time (two weeks) he was suspended.

The writer hereby apologies for the delay in reply as I was away on leave between August 6 to September 10, 1976, and also misunderstood the undertaking given by the parties.
