1 Prestige Homes Limited have applied to this Court to be joined as respondents in a pending appeal ‘In the Matter of lands known as No. 2 Retreat Avenue in the parish of St. Andrew, and in the matter of the discharge and modification of covenants numbered 1 and 2 of the Certificates of Title of the said lands.’ The pending appeal is between Vera Ines Henriques et al, as appellants, and Lorraine Issa, as the respondent.

2 The applicants in their notice of motion sate that having acquired title to the lands known as No. 2 retreat Avenue in the parish of St. Andrew, being the lands comprised in the Certificates of title registered formerly in the name of Lorraine Issa, and being bona fide purchasers for value thereof without notice of any restrictive covenants affecting the same, save those mentioned in the transfer, and being interested in, and likely to be affected by any order of this Court in this matter, therefore, they seek to be joined as parties in the capacity of respondents, so that they may take part in the...
